Acceptable Use Policy

Introduction
ChicagolandFishing.com's Acceptable Use Policy (AUP) is designed to help protect it's visitors and the Internet community in general from fraud, abuse of resources, and irresponsible or illegal activities.

The persons and organizations using ChicagolandFishing.com who publish materials and information which are accessible through this website are solely responsible for the content of such materials and information, and are solely responsible to know and to comply with all laws applicable to the publication of such materials and information. ChicagolandFishing.com and it's creator will cooperate with legal authorities in the investigation of any suspected criminal or civil infringements.

ChicagolandFishing.com and it's moderators reserve the right, and will, at their discretion remove any posts or pictures.They may do so if they feel the post or picture is illegal, fraudulous, infringes on the rights of others or in any way abuses the resources of ChicagolandFishing.com. Any violation of the Acceptable Use Guidlines will also result in a post to the Bulletin Boards, Club or Email directory being removed. Any violation of the Acceptable Use Guidlines while using ChicagolandFishing.com's Image Hosting Service will result in the users account being closed without a refund.

Advertising in posts
Advertising of any kind is not allowed in posts made to the forums.
This includes website links.
The exception to this rule is posts made in the Trading Post & Classified Ads forum.
Posts made to this forum must follow the posting guidlines set forth for that forum.
Website links in signatures are not allowed.
Links in the Website section of a user's profile will be reviewed by the ChicagolandFishing.com staff and may or may not be allowed.

Acceptable Use Guidelines
ChicagolandFishing.com's services are only to be used for lawful purposes. Customers may not transmit, retransmit or store material in violation of any Federal or state laws or regulations, including, but not limited to, obscenity, indecency, defamation or infringement of trademark or copyright. ChicagolandFishing.com's visitors or users may not, nor may they permit or assist others to, abuse or fraudulently use it's services, including but not limited to the following activities:  

Child Pornography: It is illegal under Federal child exploitation statutes to possess, produce, receive, transport or distribute by any means, including computer, visual depictions of "sexual intercourse" and/or "sexually explicit conduct" involving children. ProBass Networks will not tolerate any use of its Products and Services surrounding these activities.

Denial of Service: Knowingly engaging in any activities that will cause a denial-of-service to any user or visitor

Distribution of Viruses: Intentional distribution of software that attempts to and/or causes damage or annoyance to persons, data, and/or computer systems are prohibited. 

Bulletin Board Posting: Forging any message header, in part or whole, of any electronic transmission, originating on or passing through ChicagolandFishing.com is in violation of this AUP.

Email Spamming: Using the emaill addresses contained in any part of ChicagolandFishing.com for the purpose of sending unsolicited Email to single or multiple recipients, sending large amounts of Email repeatedly to a person to harass or threaten, or attempting to use the bulletin boards as a mail drop or name server for SPAM will not be tolerated. Such offenses negatively impact system performance and are an abuse of Internet resources. Those found guilty of violation will be band from using ChicagolandFishing.com.

Fraudulent Activities: Fraud is an intentional misrepresentation or misleading statement, writing, or activity made with the intent that the person receiving it will act upon it.

Hacking or "Spoofing": ChicagolandFishing.com will not tolerate any customer or end-user attempting to access any computer resource not belonging to that user, or attempting to penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.

Network Sabotage: Any use of ChicagolandFishing.com's products and services to interfere with the use of Internet resources or the ChicagolandFishing.com website by other customers or visitors is prohibited.

Pyramid Schemes: Posting of such scams may result in legal inquiries, and/or being banned from ChicagolandFishing.com

Unlawful Acts: Any use of ChicagolandFishing.com's products and services to violate the law or in aid of any unlawful act is strictly prohibited. 

Facilitating a Violation of this AUP: Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP, which includes the facilitation of the means to spam, bypass ChicagolandFishing.com's advertisers, or disrupt revenue is prohibited.

Violations and Enforcement 
At ChicagolandFishing.com and it's moderators sole discretion, violations may result in a warning to the offender, suspension of posting priviledges and or being banned from posting. ChicagolandFishing.com will enforce this AUP according to the severity of the offense and violator's history of prior AUP infringements. Repeated offenses will result in immediate banning from the use of ChicagolandFishing.com.

ChicagolandFishing.com has no practical ability to monitor all conduct, communications, or content which might violate this AUP prior to its transmission on the ChicagolandFishing.com website but may do so at its discretion. Therefore, ChicagolandFishing.com, it's owner and creator, and it's moderators, do not assume liability for violation of the aforementioned infringements.  

ChicagolandFishing.com reserves the right to modify this AUP at any time without prior notification to customers. 
 

Concerning Illinois law please keep the following in mind. (720 ILCS 135/0.01) Sec. 0.01. Short title. This Act may be cited as the Harassing and Obscene Communications Act. (Source: P.A. 90-578, eff. 6-1-98.) (720 ILCS 135/1) Sec. 1. Any person in this State who sends messages or uses language or terms which are obscene, lewd or immoral with the intent to offend by means of or while using a telephone or telegraph facilities, equipment or wires of any person, firm or corporation engaged in the transmission of news or messages between states or within the State of Illinois is guilty of a Class B misdemeanor. The use of language or terms which are obscene, lewd or immoral is prima facie evidence of the intent to offend. (Source: P.A. 77-2620.) (720 ILCS 135/1-2) Sec. 1-2. Harassment through electronic communications. (a) Harassment through electronic communications is the use of electronic communication for any of the following purposes: (1) Making any comment, request, suggestion or proposal which is obscene with an intent to offend; (2) Interrupting, with the intent to harass, the telephone service or the electronic communication service of any person; (3) Transmitting to any person, with the intent to harass and regardless of whether the communication is read in its entirety or at all, any file, document, or other communication which prevents that person from using his or her telephone service or electronic communications device; (3.1) Transmitting an electronic communication or knowingly inducing a person to transmit an electronic communication for the purpose of harassing another person who is under 13 years of age, regardless of whether the person under 13 years of age consents to the harassment, if the defendant is at least 16 years of age at the time of the commission of the offense; (4) Threatening injury to the person or to the property of the person to whom an electronic communication is directed or to any of his or her family or household members; or (5) Knowingly permitting any electronic communications device to be used for any of the purposes mentioned in this subsection (a). (b) As used in this Act: (1) "Electronic communication" means any transfer of signs, signals, writings, images, sounds, data or intelligence of any nature transmitted in whole or in part by a wire, radio, electromagnetic, photoelectric or photo-optical system. (2) "Family or household member" includes spouses, former spouses, parents, children, stepchildren and other persons related by blood or by present or prior marriage, persons who share or formerly shared a common dwelling, persons who have or allegedly share a blood relationship through a child, persons who have or have had a dating or engagement relationship, and persons with disabilities and their personal assistants. For purposes of this Act, neither a casual acquaintanceship nor ordinary fraternization between 2 individuals in business or social contexts shall be deemed to constitute a dating relationship.
